i think it's because it's the 40th/41st song that Dave wrote, but the 42nd/43rd the band wrote or something like that

If you remove them, "#40" and "#41" fall in line and "#34" and "#36" do not. This leads Wasting Time to make a bold assumption: Once Griesar left, his song and Tinsley's were not included in the numbering scheme.
