DVD's Legal?

Unread post by Ranting Thespian » Sun Jan 25, 2004 4:52 am

Um, I read somewhere, I think, that video taping is illegal for the band's taping policies. Is this true? If it is, why are we violating it on here? If not, why hasn't anyone told me already? If it is illegal, why hasn't the band done steps to track down video cameras at shows as well as online?

I can answer part of that question. I dont know if its legal or not but when you have 20,000+ people all in one space the last thing security is worried about is some guy video taping it. Also, they make these video recorders small as crap now. I'm all for it as long as they dont get sold. They are for the fans.

It's illegal to tape, But security doesn't usually do shit about it...

These dvds are just an enjoyment for the fans... made out of the pure generosity of other people. As long as no one is selling them...

does it really hurt anyone?

I can't see it hurting anyone , so long there is no profit in it , and as it is stated on some of the DVD's on the opening screen , it is for the fans by the fans and should not be sold :)

It's against the band's policies to tape them, not to trade them. So we trade away :)

I know in an interview with MTV, Dave Matthews said that he is an avid supporter of free music. He said it's the reason he did the L@LC and L@RR CDs, and the why he came out with the Listener Supported DVD. But I know there are other bands out there that would say otherwise, and this is, again, why Mr. Matthews is the MAN!

I dont think that Dave really gives two shits about shows being video taped. Why would he? Just so long as they are not being sold and the fans are very cool about it. i.e. not bringing in huge camera equipment. I could be wrong though, maybe there is something I don't know on why video taping isn't allowed?

Just dont sell em. And if you see any on ebay, report them to dmb. The management actually does follow up on people selling if you notify them.

The bottom line is that if theyre available, I'm not going to pass them up. That doesnt mean I'm going to be the one to go tape shows and put my ass on the line. I dont see it as any more of a violation of rights than downloading mp3s. I guess if you object, dont trade for them. Simple as that. But youre missing out.

i've recently gotten into the whole DVD thing, and i've been thinking the same thing, but think about it - i'm sure someone in DMB or a crew member or the webmaster for the site or SOMEONE related to the band knows about em, or all the sites about them, or the others message board sites that have entire forums for DMB DVDs, i think something would've been done already if they really cared to stop it

Ranting.....

DMB policy is that there is no video taping of shows. If they catch you taping at a show, they can and have confiscated video cameras. They have not come out and said that trading video shows is a violation however. I know this is a fine line with a lot of gray in it.

Over at sharingthegroove.org, they are about as concerned with not violating Band Policy as any group I know...they simply will not allow trading of videos (or audio for that matter) on their site if a band has come out with a direct policy on trading. Trading DMB videos is fast and furious over there. Trading commercially released DVD's of any kind is strictly frobidden and will not be tolerated.

As far as this site is concerned, I have discussed this with Jared and he is all for it. There was a lot of concern when the first DVD tree showed up here for the Benoyra Hall show. He said the same thing..the 1st hint from DMB Management that this practice is a violating their policy , then video trading on DMBTabs will be history.

Are they illegal? I don't know. Hell we can't even get a response from DMB Management about a guy trying desperately to go about things the responsible and legal way in releasing a Dave Matthews Guitar Playing Instructional DVD....someone who is unwilling to violate copyright laws.someone who is willing to pay royalties..etc, etc. In my mind, if they are out there, I will trade them and, more importantly, spread them to as many people that my free time allows. The shows are too good to pass up.

As other have said, my main concern is that these vidios are never ever sold....it absolutely must be a free exchange.

Now....the first one is always the hardest, and I would be honored to be the first to "do you" :D

Give me a PM and I will let you know what I have available.

I do want to go on record to thank you about your conceren (and I am not kidding)....particularly your concern about how this effects DMBTabs.

Peace my friend

ok, I guess until dmb says something in their taping policies about trading videos, I guess it's ok. I also don't want to get rid of all the mpegs I've download, lol ;) .
