#41 Benaroya Hall Intro

I have been abroad for about 3 months now without my guitar and have been going nuts. I go home in three days and so I am getting anxious to play. In light of this I have been watching videos on youtube. My question is this: It seems like on the intro when Dave plays the third chord he does not use the 8th fret
